Title 477 NAC 20 – Definitions Pertaining To Non-Modified Adjusted Gross Income (Non-Magi) Programs.
The proposed changes update, clarify, and add definitions. The proposed changes also update formatting.
Title 477 NAC 23 – Resources For Non-Modified Adjusted Gross Income (Non-Magi) Programs.
The proposed changes clarify under which circumstances a trust can be counted as an available resource. The regulation change will not impact most beneficiaries, however, the change will impact those eligible for Medicaid in the Aged or Disabled category who are also beneficiaries of a trust. The proposed change will ensure continued compliance with federal law and retain the current policy.
